By registering an account, accessing, or using any service provided by MDRCloud (“MDRCloud”, “we”, “us”, or “our”) — including but not limited to Virtual Private Servers (VPS), LXC Containers, KVM Cloud Servers, Game Servers, and any related infrastructure or management tools — you (“Client”, “you”) agree to be bound by these Terms of Service and Client Service Agreement (“Terms”).
If you do not agree with any part of these Terms, you must immediately cease use of all MDRCloud services and close your account.
These Terms apply in addition to any specific service order confirmations, plan documentation, or supplemental agreements executed between MDRCloud and the Client.
MDRCloud provides cloud infrastructure and managed hosting services, including:
MDRCloud reserves the right to modify, enhance, or discontinue any service at any time, with reasonable notice provided to affected Clients where feasible.
You must be at least 18 years of age to register for and use MDRCloud services. By creating an account, you represent and warrant that you meet this age requirement and that all information you provide during registration is accurate, complete, and current.
You are solely responsible for maintaining the confidentiality of your account credentials (username, password, API keys) and for all activity that occurs under your account. You must notify MDRCloud immediately at support@mdrcloud.com if you suspect any unauthorised access to or use of your account.
Each individual or business entity may hold one active account. Creating multiple accounts to circumvent usage restrictions or abuse fair-use policies is prohibited and may result in immediate account termination without refund.
All payments are processed securely by Stripe. By providing payment details, you authorise MDRCloud to charge the applicable fees to your nominated payment method on the billing cycle applicable to your service plan. Stripe’s own terms and privacy policy apply to the payment processing transaction.
All prices are quoted and charged in British Pounds Sterling (GBP £). Current pricing is as displayed on the MDRCloud website and within the MDRCloud ONE client portal at the time of purchase. Prices are inclusive of VAT where applicable to the Client.
Services are billed on a monthly basis in advance. Invoices are automatically generated and payment is collected on each renewal date. Failure to pay within 7 days of the invoice due date may result in service suspension.
Due to the immediate automated provisioning nature of cloud infrastructure services, all sales are generally non-refundable once a server has been deployed. However, MDRCloud may, at its sole discretion, offer a pro-rated refund or service credit in circumstances where:
Refund requests must be submitted via the MDRCloud ONE support portal within 7 days of the charge. Approved refunds will be processed within 10 business days via the original payment method.
You agree to use MDRCloud services only for lawful purposes and in a manner consistent with all applicable UK, EU, and international laws and regulations. The following activities are strictly prohibited:
MDRCloud reserves the right to immediately suspend or terminate any account found to be in violation of this Acceptable Use Policy, without prior notice or refund.
Each MDRCloud service plan includes defined resource allocations (vCPU cores, DDR4 RAM, NVMe SSD/SAN Storage, and network port speed). You agree to operate your services within these specified allocations.
All plans include connectivity on a 1 Gbps port (LXC Container plans) or a dedicated port (KVM/vSphere plans). Sustained traffic that adversely impacts other clients on shared infrastructure may be throttled or subject to discussion and additional charges at MDRCloud’s discretion.
Storage is allocated per plan, ranging from 15 GB to 1 TB NVMe SSD or NVMe SAN. Exceeding allocated storage limits may result in service suspension until the excess data is removed or a plan upgrade is actioned.
The following workloads are prohibited without prior written approval: cryptocurrency mining, Tor exit nodes, command-and-control infrastructure, botnets, and any workload that generates excessive disk IOPS degrading shared hypervisor performance.
MDRCloud targets a 99% network uptime guarantee across all service plans, measured on a monthly rolling basis. This SLA excludes:
In the event of downtime exceeding the guaranteed uptime threshold, Clients may request a service credit proportionate to the duration of the verified outage. Credits are applied to the account balance as credit notes and are not redeemable as cash. Credit claims must be submitted within 14 days of the incident via the MDRCloud ONE support portal, with relevant evidence.
MDRCloud is committed to providing real human support — staffed by engineers, not bots or outsourced agents. All technical and billing support is handled by the MDRCloud team.
MDRCloud aims to respond to support tickets within 24 hours on business days (Monday–Friday, UK time). Critical infrastructure outages are handled on a priority basis outside normal hours.
Clients are expected to communicate respectfully with MDRCloud staff at all times. Abusive, threatening, or harassing behaviour towards support personnel may result in immediate account suspension.
You are solely responsible for the data stored on and transmitted through your MDRCloud services. MDRCloud does not guarantee the availability of client data beyond what is specified in your service plan and this SLA.
Unless explicitly stated as an included feature of a specific service plan, MDRCloud does not provide automatic or scheduled backup services. Clients are strongly encouraged to maintain independent, offsite backups of all critical data.
Upon termination or suspension of your account for any reason, MDRCloud may permanently and irrecoverably delete all data stored on your services after a 7-day grace period. MDRCloud accepts no liability for data lost after this grace period has elapsed.
All trademarks, logos, service marks, website content, software, and branding associated with MDRCloud are the exclusive intellectual property of MDRCloud and may not be reproduced, distributed, or used without prior written consent.
You retain full ownership of any content, code, or data that you deploy on MDRCloud infrastructure. By using MDRCloud services, you grant MDRCloud a limited, non-exclusive, royalty-free licence to access your data solely for the purpose of providing, maintaining, and supporting the contracted services.
You may cancel your services at any time through the MDRCloud ONE client portal. Cancellation takes effect at the end of the current billing period unless otherwise specified. No refund will be issued for any remaining prepaid period unless otherwise agreed in writing.
MDRCloud reserves the right to suspend or terminate your account and services, with or without prior notice, for:
Upon termination for cause, no refunds will be issued. MDRCloud reserves the right to pursue recovery of any outstanding charges through legal means.
To the fullest extent permitted by applicable law, MDRCloud’s aggregate liability to you for any claim arising out of or relating to these Terms or the services shall not exceed the total fees paid by you to MDRCloud in the three (3) months immediately preceding the event giving rise to the claim.
MDRCloud shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of revenue, loss of data, loss of profits, loss of goodwill, or business interruption, even if MDRCloud has been advised of the possibility of such damages.
Nothing in these Terms shall exclude or limit liability for death, personal injury, or fraud caused by MDRCloud’s negligence, to the extent such exclusion is not permitted by applicable law in England and Wales.
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.
Both parties irrevocably submit to the exclusive jurisdiction of the courts of England and Wales to settle any dispute or claim arising out of or in connection with these Terms.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
MDRCloud reserves the right to update or amend these Terms at any time. Where changes are material, MDRCloud will provide reasonable notice to registered Clients via the email address associated with your MDRCloud ONE account and/or via a notice posted on the MDRCloud website.
Your continued use of MDRCloud services following notification of changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must cease using the services and close your account before the effective date of the changes.
